TERMS & CONDITIONS

The Wanderlush Collective LLC

PLEASE READ CAREFULLY BEFORE BOOKING 

These Terms & Conditions (“Terms”) apply to all travel experiences, services, offerings, and digital content provided by The Wanderlush Collective LLC (“Wanderlush”), including but not limited to group trips, curated travel experiences, and any related products or services. These Terms also govern your access to and use of Wanderlush’s website and any associated platforms, content, or communications.

These Terms constitute a legally binding agreement between Wanderlush and any individual who books, participates in, accesses, or otherwise engages with a Wanderlush experience, service, or website (each, the “Participant,” “Traveler,” “Guest,” or “you”).

By accessing or using the Wanderlush website, or by booking or participating in a Wanderlush Travel Experience (a “Trip” or “Group Trip”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

By making a booking, you represent and warrant that you are at least 18 years of age and legally capable of entering into this agreement, and that you accept these Terms on behalf of yourself and any individuals included in your reservation. 

 

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New York. Any claims, disputes, or legal proceedings arising out of or relating to these Terms & Conditions or participation in a Wanderlush experience shall be exclusively brought in the state or federal courts located within the State of New York, and you hereby consent to the personal jurisdiction and venue of such courts.

 

COMPANY ROLE

Wanderlush operates as a travel coordinator, trip curator, group experience host, and intermediary between travelers and independent third-party service providers. Wanderlush curates and coordinates group travel experiences and arranges travel components such as accommodations, ground transportation, activities, guides, and dining experiences through independent third-party suppliers. As part of its services, Wanderlush designs itineraries, facilitates reservations, and coordinates travel logistics in collaboration with trusted local partners and service providers in each destination. 

 

Wanderlush does not own, manage, operate, or control airlines, hotels, villas, transportation providers, restaurants, tour operators, activity providers, or other travel service suppliers. All such services are provided by independent third parties who operate under their own management and terms.

 

ELIGIBILITY TO PARTICIPATE

The Participant must be at least eighteen (18) years of age at the time of booking.

By completing a booking and securing a reservation in a Wanderlush Trip, the Participant confirms that they are eighteen (18) years of age or older and legally able to enter into binding agreements, including these Terms & Conditions and any required waivers or liability releases. Wanderlush reserves the right to request proof of age if necessary and to cancel any booking that does not meet the minimum age requirement.

Certain trips may have additional eligibility requirements, including but not limited to age ranges, gender-specific experiences, physical activity levels, or other participation criteria. These requirements will be clearly stated in the trip details before or during the booking process.

 

Right to Refuse

Wanderlush reserves the right to refuse any booking or participation in a Trip at its sole discretion, including but not limited to situations where the Participant’s behavior, prior conduct, or circumstances may negatively impact the experience, safety, or wellbeing of other Participants or the operation of the Trip.

PRICING & INCLUSIONS

All Trip prices are quoted per person, per Trip, unless otherwise expressly stated. Pricing is based on the inclusions and itinerary outlined at the time of booking. Trip pricing, inclusions, and availability are subject to change prior to booking and confirmation. Once a booking is confirmed and payment is received, the agreed-upon price and inclusions for that booking will be honored, except as otherwise permitted under these Terms & Conditions.

Unless otherwise specified, Trip prices generally do not include:

• international or domestic airfare

• travel insurance

• personal expenses

• transportation not listed in the itinerary

• optional activities not listed in the itinerary

• meals not listed as included

• visas or entry documentation

• tips and gratuities unless specified

The Participant is responsible for reviewing Trip details carefully prior to booking.

 

BOOKING & PAYMENT

A booking is confirmed and these Terms shall apply once the Participant:

• submits the applicable deposit required (when selecting a payment plan, if offered)

• submits the required and accurate booking information

• agrees to these Terms & Conditions

• agrees to the Participant Waiver & Release of Liability

 

Participants may have the option to either pay in full at the time of booking or select an available payment plan, where offered. When a payment plan is selected, a deposit is required to reserve a spot on the Trip. Deposit amounts may vary by Trip and will be disclosed at the time of booking. Payment plans may be offered through approved payment platforms. The Participant is responsible for completing all scheduled payments. Failure to make payments in accordance with the agreed payment schedule, including missed or late installment payments, may result in cancellation of the booking and forfeiture of any payments made at the sole discretion of Wanderlush.

All bookings must be paid in full no later than sixty (60) days prior to the Trip start date, unless otherwise specified at the time of booking. Failure to complete the remaining balance by the final payment deadline may result in automatic cancellation of the reservation at the sole discretion of Wanderlush. In the event a booking is cancelled due to non-payment of the remaining balance, the Participant will not be entitled to any refund of payments previously made, including the deposit. Wanderlush reserves the right to retain all payments made as liquidated damages due to the difficulty in replacing a reservation within a limited-capacity group experience. In such cases, any payments previously made may be forfeited in accordance with the applicable cancellation policy, and the reserved spot may be released and offered to another Participant, at the discretion of Wanderlush.

All prices are listed in U.S. Dollars (USD) unless otherwise stated.

 

PAYMENT PROCESSING

Payments for Wanderlush Trips may be processed through secure third-party payment service providers. By submitting payment information, the Participant acknowledges and agrees that payment transactions are processed by independent third-party payment processors and that the Participant may be subject to the terms, conditions, and privacy policies of those providers. Third-party payment processors may charge transaction, processing, currency conversion, or other service fees associated with the payment method used. These fees are determined and collected by the payment processor directly and are not controlled, retained, or managed by Wanderlush.

 

Wanderlush does not store or directly process credit card or payment information and is not responsible for the security, performance, or policies of any third-party payment processor. The Participant agrees that by providing payment information and completing a transaction, they authorize the selected payment processor to charge the payment method provided in accordance with the booking and payment terms associated with the Trip. Wanderlush's collection and use of personal information is governed by its Privacy Policy, which is incorporated herein by reference and available on the Wanderlush website.

 

USE OF TRIP MATERIALS

All materials provided to the Participant in connection with a Wanderlush Trip, including but not limited to itineraries, travel guides, recommendations, digital downloads, and other trip-related documents (“Trip Materials”), are provided for personal, non-commercial use only. The Participant may not reproduce, distribute, share, sell, or otherwise use such materials for commercial purposes without prior written consent from Wanderlush.

 

TRAVEL DOCUMENTS & ENTRY REQUIREMENTS

​The Participant is responsible for ensuring they have all required travel documentation necessary for their Trip, including but not limited to:

• a valid passport

• visas (if required)

• vaccination documentation

• entry permits or other government-required documentation

Travel requirements, entry regulations, and health documentation requirements may change at any time. The Participant is responsible for verifying all travel requirements with the appropriate government authorities and ensuring that all necessary documentation is obtained within the required timeframes prior to Trip departure. Entry requirements, including passports, visas or other documentation, may require advance application and processing time, which varies by destination.

Wanderlush may provide general information or reminders regarding travel requirements prior to departure for convenience purposes. However, such information is provided as a courtesy only, and the Participant remains solely responsible for independently verifying all travel requirements and ensuring they possess the proper documentation prior to travel. Wanderlush is not responsible for denied boarding, refused entry, delays, or travel disruptions resulting from missing, invalid, or insufficient travel documentation. If the Participant is unable to travel due to documentation issues the Participant will not be eligible for refunds.

 

TRAVEL INSURANCE

Travel insurance is not required for most Wanderlush Trips; however, it is strongly recommended. Certain destinations or entry requirements may require proof of travel insurance as a condition of entry, and the Participant is solely responsible for ensuring compliance with such requirements.

Travel insurance may provide coverage for circumstances including, but not limited to:

• trip cancellation or interruption  

• medical emergencies  

• emergency evacuation or repatriation  

• lost, stolen, or delayed luggage  

• travel delays or missed connections

The Participant is solely responsible for purchasing and maintaining adequate travel insurance coverage for the duration of the Trip, including, but not limited to, coverage for medical expenses, emergency evacuation, and trip cancellation. The Participant is also responsible for reviewing the terms of their travel insurance policy to ensure it provides appropriate coverage for the destination and any activities included in the itinerary.

Wanderlush does not provide travel insurance and is not responsible for any financial losses, medical expenses, injuries, evacuation costs, or other damages incurred as a result of the Participant’s failure to obtain appropriate travel insurance coverage. The Participant acknowledges that the purchase of travel insurance and review of policy coverage is their sole responsibility.

CANCELLATION & REFUND POLICY

Standard Cancellation & Refund Policy

Unless otherwise specified on the Trip booking page, this cancellation and refund policy applies to all bookings, regardless of whether the Participant pays in full at the time of booking or selects a payment plan.

 

Deposits are fully refundable within seven (7) calendar days of booking, including the initial booking date, provided the booking was made more than seven (7) days before the Trip start date. After seven (7) calendar days, the deposit becomes non-refundable and non-transferrable. Once a deposit is made and a booking has exceeded seven (7) calendar days, refund eligibility is determined by the number of days before the Trip start date that Wanderlush receives the cancellation request.

To remain eligible for any potential refund according to the cancellation schedule below, the Participant’s payment plan must be current and in good standing at the time the cancellation request is submitted.

120+ DAYS BEFORE DEPARTURE DATE

  • Full Refund of payments (excluding deposit)

90–119 DAYS BEFORE DEPARTURE DATE

  • 50% refund of payments made (excluding deposit)

61–89 DAYS BEFORE DEPARTURE DATE

  • 25% refund of payments made (excluding deposit)

60 DAYS OR LESS 

  • Non-refundable

Refund eligibility may vary by Trip due to supplier policies.

 

No refunds will be issued for:

• missed flights/flight changes or cancellations

• missed activities

• unused portions of the itinerary

• late arrivals or early departures

Participants are strongly encouraged to purchase travel insurance.

PEAK TRAVEL & SPECIAL EVENT REFUND POLICY

Certain Wanderlush Trips may take place during peak travel periods, holidays, special events, or high-demand seasons (including but not limited to New Year’s Eve, festivals, and major cultural events). Due to increased demand and stricter supplier policies during these times, Wanderlush reserves the right to implement modified, more restrictive cancellation and refund terms for such trips.

For Trips designated as peak or special event experiences:

  • Payment deadlines may be accelerated

  • Cancellation windows may be shorter

  • Refund eligibility may be reduced or eliminated

Any such modified terms will be clearly communicated on the specific trip page and/or at the time of booking. By completing a booking, the Participant acknowledges and agrees to the refund terms applicable to that specific trip. Wanderlush shall not be responsible for any additional losses incurred due to stricter policies associated with peak travel periods or special events.

All cancellation requests must be submitted in writing via email to the contact address provided in Wanderlush booking or Trip-related communications. This requirement applies to all cancellation requests under both the Standard Cancellation & Refund Policy and the Peak Travel & Special Event Refund Policy. Approved refunds will be processed within five (5) to ten (10) business days to the original payment method.

Notwithstanding the foregoing, the Participant may have certain rights under applicable consumer protection laws, including those of the State of New York, which cannot be waived. Wanderlush will honor such rights to the extent required by law.

BOOKING TRANSFERS

​If a Participant is unable to attend a Trip, Wanderlush may, at its sole discretion, allow the booking to be transferred to an alternate Participant, provided that:

• the alternate Participant meets all Trip eligibility requirements

• supplier policies permit the change

• all required documentation is completed prior to departure

 

Deposits are non-refundable and non-transferable after seven (7) calendar days of the original booking date. The alternate Participant will be required to submit a new deposit to secure the reservation. The alternate Participant must review and agree to these Terms & Conditions and complete all required waivers and liability releases prior to being confirmed on the Trip. The alternate Participant will assume responsibility for the remaining balance of the booking. Administrative or name change fees may apply.

Wanderlush is not responsible for any private financial arrangements between the original Participant and the alternate Participant.

 

CANCELLATIONS OR CHANGES BY WANDERLUSH

Wanderlush reserves the right to cancel or modify a Trip due to circumstances including but not limited to:

• insufficient number of Participants

• safety concerns

• supplier availability

• weather or natural events

• government restrictions

• force majeure events

If Wanderlush cancels a Trip before departure, the Participant may be offered:

• a refund of payments made to Wanderlush, including the deposit

• a credit toward a future trip

• the option to transfer to another available trip (subject to availability) 

Wanderlush is not responsible for any non-refundable, incidental, or consequential expenses incurred by the Participant outside of the Trip price, including but not limited to:

• international or domestic flights

• travel visas or passport fees

• travel insurance policies

• independently booked accommodations or transportation

• optional activities not included in the official itinerary

• personal expenses

• childcare, pet care, or house-sitting arrangements

• lost wages, time off work, or other personal commitments

 

The Participant is solely responsible for any such expenses, and no reimbursement or compensation will be provided by Wanderlush in the event of a Trip cancellation, modification, or rescheduling. The Participant is responsible for reviewing cancellation policies associated with any independently arranged travel components.

 

MINIMUM PARTICIPANT REQUIREMENT

Some Wanderlush experiences require a minimum number of Participants in order to operate as planned. If the minimum number of Participants is not reached, Wanderlush reserves the right to cancel, modify, or reschedule the Trip. The Participant will be notified as soon as reasonably possible if a Trip does not meet the required minimum.

 

In the event that Wanderlush cancels a Trip due to insufficient participation, the Participant will be offered the option to credit their booking to a future Trip or transfer their booking to an alternate destination (subject to availability) or choose to receive a refund of all payments made to Wanderlush for the Trip.

Wanderlush is not responsible for any additional costs incurred by the Participant outside of the Trip price, including but not limited to flights, travel insurance, visas, or other personal travel arrangements. Refunds will apply only to payments made directly to Wanderlush and may be subject to non-refundable payment processing fees charged by third-party payment processors.

ITINERARY CHANGES 

Travel itineraries are thoughtfully curated to provide an overall experience and general guide to the destination; however, specific activities, locations, and experiences are not guaranteed and do not form a fixed or binding part of the agreement between Wanderlush and the Participant.

 

Each itinerary is designed in good faith based on current conditions, local expertise, and the intended experience of the trip. However, changes may be necessary due to factors including, but not limited to, weather conditions, local events, supplier availability, safety considerations, or operational needs. Wanderlush reserves the right to modify, adjust or substitute any portion of the itinerary, accommodations, activities, or sequence of events when necessary for safety, operational feasibility, or to enhance the overall travel experience for the Participant. In such circumstances, reasonable substitutions of comparable value or quality may be made. These adjustments do not constitute grounds for a refund.

The Participant acknowledges that travel is dynamic in nature and agrees to remain flexible, understanding that adjustments may enhance or alter the planned experience.

 

Wanderlush will make reasonable efforts to notify the Participant of significant itinerary changes in advance when possible; however, due to the nature of travel, some changes may need to be made without prior notice.

 

TRIP REPRESENTATIONS & MARKETING MATERIALS

All itineraries, accommodations, activities, and descriptions provided by Wanderlush are intended to represent the planned travel experience. Such information may be presented on Wanderlush’s website, Trip description pages, booking pages, or in other promotional or informational materials. However, details may vary due to operational, environmental, or supplier-related factors. Photographs, descriptions, and promotional materials are provided for illustrative purposes only and may not reflect exact conditions at the time of travel. Some images, descriptions, or other promotional materials may be provided by third-party suppliers, including but not limited to accommodations, transportation providers, activity operators, or local partners. These materials are shared with the Participant based on the information made available to Wanderlush at the time of publication. Minor variations in accommodations, activities, itinerary details, or conditions at the destination do not constitute a material change to the Trip and do not entitle the Participant to refunds, credits, or other compensation.

 

In the event that a Participant believes the condition, quality, or standard of accommodations, itinerary, or other included services differs significantly from what was represented, the Participant is encouraged to notify Wanderlush or its designated Trip host or representative as soon as possible during the Trip so that reasonable efforts can be made to address the concern in real time. Wanderlush will make good faith efforts to provide suitable alternatives or solutions where feasible. Concerns raised after the conclusion of the Trip may be considered at Wanderlush's sole discretion but do not entitle the Participant to refunds, credits, or compensation.

LATE ARRIVALS & MISSED SERVICES

The Participant is responsible for arranging their own flights and ensuring arrival at the destination within the designated arrival window for the Trip. The designated arrival window, along with any related transfer or meeting details, will be communicated to the Participant in the booking confirmation and/or subsequent pre-departure communications provided by Wanderlush after booking. The Participant is responsible for reviewing all such communications and ensuring their travel arrangements align with the provided arrival window. Participants are required to submit their flight details to Wanderlush no later than sixty (60) days prior to the Trip start date, or by the deadline communicated in pre-departure materials. Flight submission instructions, including the appropriate contact method, will be provided in Wanderlush booking or Trip-related communications.

 

Airport transfers provided by Wanderlush, when included as part of the Trip, are available only during the designated arrival window and cannot be guaranteed if the Participant arrives outside of this timeframe or fails to provide flight details by the required deadline. In such cases, the Participant may be required to arrange and cover the cost of their own transportation to the accommodation or designated meeting point.

If the Participant arrives late, departs early, or otherwise misses any portion of the itinerary, including but not limited to airport transfers, accommodations, activities, meals, or group experiences, no refunds, credits, or substitutions will be provided for any unused or missed services. Should the Participant arrive after the official start of the Trip or outside of the designated arrival window the Participant is solely responsible for arranging and covering the cost of transportation necessary to join the group at the current location.

ACCOMMODATIONS & OCCUPANCY TYPES

Accommodation Changes

 Wanderlush makes reasonable efforts to secure the accommodations described for each Trip; however, all accommodations are subject to availability at the time of booking, ongoing availability throughout the booking period, and final confirmation by third-party suppliers. Trip bookings may remain open for a period of time prior to departure, as indicated on the trip booking page. During this time, accommodation availability, room configurations, and specific properties are subject to change based on demand and supplier availability.

 

In the event that a selected hotel, villa, or specific room type becomes unavailable for any reason, including but not limited to supplier limitations, inventory changes, or booking demand, Wanderlush reserves the right to substitute accommodations with a comparable property or room of equal or greater standard. Any such substitutions will be made in good faith and will not materially impact the overall quality or experience of the Trip.

Occupancy Types

Room configurations, layouts, and bedding arrangements are determined in coordination with these suppliers and will be clearly disclosed to guests prior to completing their booking.

All accommodation types, occupancy levels, and bedding configurations will be explicitly stated at the time of booking.

 

Double Occupancy: Two guests assigned to one bedroom. Bedding will consist of either two separate beds (e.g., twin or double beds).

Double Occupancy (Shared Bed): Two guests assigned to one shared bed within a bedroom. 

Triple Occupancy: Three guests assigned to one bedroom. Bedding configurations will be specified at the time of booking.

Private Room / Single Occupancy: One guest assigned to a private bedroom. 

The Participant is responsible for reviewing all accommodation details, including room type, occupancy, and bedding configuration, prior to completing their booking. Wanderlush does not guarantee specific room layouts, bedroom sizes, views, or bathroom configurations beyond what is confirmed at the time of booking.

Room Assignments & Pairing

Room assignments are made at the sole discretion of Wanderlush. Wanderlush will make reasonable efforts to thoughtfully pair Participants in shared accommodations based on available information, including but not limited to gender identity, booking selections, and responses provided through pre-trip or booking questionnaires; however, compatibility and specific rooming arrangements cannot be guaranteed. By selecting shared accommodations, the Participant acknowledges and accepts that they may share a bedroom or sleeping arrangement with another guest, which may include individuals of a different gender identity. Dissatisfaction with assigned accommodations that are consistent with the selected booking category does not constitute grounds for refunds, credits, or compensation.

Wanderlush reserves the right to modify room assignments as necessary for operational or logistical reasons.

 

Shared Spaces & Group Accommodations

Depending on the destination and property type, accommodations may include hotels, private villas, or other shared properties. In accommodations such as private villas or similar, the Participant should expect shared common areas, including but not limited to kitchens, living spaces, and outdoor areas, regardless of room type selected.

HEALTH & MEDICAL ELIGIBILITY

The Participant is solely responsible for ensuring that they are physically, mentally, and medically able to participate in the trip and any activities included in the itinerary. Some Wanderlush Trips may involve physical activity or outdoor conditions, including but not limited to walking tours, hiking, swimming, water activities, uneven terrain, or other physically demanding experiences. By booking a Wanderlush Trip, the Participant confirms that they are in suitable condition to travel and participate and, where appropriate, have consulted a medical professional regarding any concerns about their ability to do so.

The Participant is responsible for managing their own health and medical needs during the Trip, including but not limited to:

  • bringing and maintaining an adequate supply of required medications

  • managing personal medical conditions, allergies, or dietary restrictions

  • obtaining any recommended or required vaccinations, prescriptions, or health-related documentation for entry into the destination country

If comfortable, the Participant is encouraged to notify Wanderlush in advance of any medical conditions, mobility limitations, allergies, or other health considerations that may affect their participation. Any information shared is provided voluntarily and will be used only to support the Participant’s experience where reasonably possible. Wanderlush will make reasonable efforts to consider such information when feasible but cannot guarantee that accommodations will be available. Wanderlush and its designated Trip hosts or representatives reserve the right to limit the Participant’s involvement in any activity, or to require the Participant to discontinue participation in part or all of the trip, if the Participant’s health, medical condition, or physical ability may pose a risk to their own safety, the safety of others, or the ability of the Trip to proceed as planned. In such circumstances, Wanderlush or its representatives may take reasonable steps to protect the Participant and the group, including seeking medical assistance, arranging medical evaluation, or modifying the Participant’s level of participation in planned activities.

Wanderlush does not provide medical services. The Participant may be required to provide an emergency contact prior to departure. In the event of a medical emergency or other situation affecting the Participant’s health or safety, Wanderlush or its representatives may contact the Participant’s designated emergency contact and assist in obtaining medical treatment when reasonably necessary.

Any medical treatment, transportation, accommodations, evacuation, or related expenses incurred by or on behalf of the Participant shall be the sole responsibility of the Participant.

 

ASSUMPTION OF RISK

The Participant acknowledges that travel, particularly international travel, may involve inherent risks and uncertainties that are beyond the control of Wanderlush.

Such risks may include, but are not limited to:

• accidents or personal injury

• illness or medical emergencies

• transportation incidents or delays

• adverse weather conditions or natural events

• political instability, civil unrest, acts of terrorism, armed conflict, or other security-related conditions in the destination

• participation in outdoor, recreational, or adventure activities

The Participant acknowledges that these risks may result in property damage, personal injury, illness, permanent disability, or death. By booking and participating in a Wanderlush Trip, the Participant voluntarily assumes all risks associated with travel and participation in Trip activities, whether known or unknown, and accepts full responsibility for their decision to travel. The Participant further acknowledges that Wanderlush cannot eliminate all risks associated with travel. 

The Participant acknowledges that they will also be required to sign a separate Participant Travel Waiver and Release of Liability prior to participating in a Trip.

 

THIRD-PARTY SUPPLIER LIABILITY

Wanderlush works with a variety of independent third-party suppliers in order to arrange and provide services before, during, and after a Trip.

These suppliers may include, but are not limited to:

• airlines

• hotels, resorts, or villas

• transportation providers or drivers

• tour guides

• activity or excursion operators

• restaurants or food providers

Wanderlush is not responsible for the acts, errors, omissions, negligence, or misconduct of any third-party suppliers.

These services are provided by independent contractors who are not employees, agents, or representatives of Wanderlush, and Wanderlush does not control the operations, policies, or practices of these third-party suppliers and therefore cannot be held liable for any injury, loss, damage, delay, inconvenience, or additional expense resulting from their actions or services.

 

RECOMMENDATIONS & INDEPENDENT ACTIVITIES

Wanderlush may provide the Participant with recommendations, suggestions, or informational resources related to restaurants, activities, transportation services, attractions, or other experiences at the destination. These recommendations are provided for informational and convenience purposes only and are not operated, managed, or controlled by Wanderlush.

Recommendations may include, but are not limited to:

• suggested activities or excursions

• transportation options (such as taxis, rideshare services, or local transportation services)

• recommended restaurants or venues

• flight suggestions or routing information

• passport or visa resources

• destination-specific tips or travel guides

If the Participant chooses to engage in any recommended or independently arranged activities they do so voluntarily, at their own discretion and risk. Wanderlush does not own, operate, or control these services and makes no representations or guarantees regarding the quality, safety, availability, pricing, or suitability of any recommended activity, business, or service. The Participant acknowledges that businesses, services, operating hours, availability, and conditions may change without notice. The Participant is responsible for conducting their own research and making independent decisions before booking or participating in any recommended activity or service.

Wanderlush shall not be liable for any loss, injury, dissatisfaction, inconvenience, financial loss, or damages arising from the use of any recommended or independently arranged services or activities.

 

PARTICIPANT CONDUCT POLICY

The Participant is expected to conduct themselves in a respectful, responsible, and lawful manner throughout the duration of the Trip, to comply with all local laws and regulations, and to follow any reasonable instructions provided by Wanderlush or its designated hosts or representatives. The Participant also agrees to respect local communities, guides, service providers, accommodations, and fellow Participants.

The following behavior is strictly prohibited and may result in removal from the Trip:

• violent, threatening, or abusive behavior toward other Participants, guides, hosts, drivers, service providers, suppliers, or members of the public

• any form of discrimination, inappropriate conduct, abusive language or behavior, including racial, gender-based, or other derogatory slurs of any kind

• any form of harassment, inappropriate sexual advances, unwanted physical contact, or non-consensual behavior

• illegal activities or violation of local laws or regulations

• theft or attempted theft of property belonging to other Participants, suppliers, accommodations, service providers, or members of the public

• reckless or dangerous behavior that may endanger oneself or others

• disruptive behavior resulting from excessive alcohol consumption or substance use

• intentional damage to property belonging to accommodations, suppliers, other Participants, or any third party

 

Wanderlush reserves the right, at its sole discretion, to remove the Participant from any activity or from the Trip entirely without refund if their conduct jeopardizes the safety, wellbeing, or experience of others, or interferes with the operation of the Trip. Any costs resulting from the Participant’s removal from the Trip, including transportation, accommodations, damages, or other expenses, will be the sole responsibility of the Participant. The Participant may also be held financially responsible for any property damage or losses caused by their actions during the Trip.

Wanderlush is not responsible for loss, theft, or damage to personal belongings, including but not limited to luggage, electronics, travel documents, money, or other personal property, whether occurring during transportation, accommodations, activities, or any other portion of the Trip. The Participant is solely responsible for safeguarding their personal belongings at all times and strongly encouraged to obtain appropriate travel insurance to protect against potential loss, theft, or damage. Failure to follow such instructions may result in restriction from certain activities or removal from the Trip without refund if such actions pose a safety risk to the Participant or others.

 

GROUP EXPERIENCE & PERSONAL EXPECTATIONS

The Participant acknowledges that Wanderlush Trips are shared group travel experiences involving multiple individuals with different personalities, preferences, religious and political backgrounds, expectations, and travel styles. While Wanderlush aims to create a thoughtful and enjoyable travel environment for all Participants, Wanderlush cannot guarantee compatibility among Participants, group dynamics, or individual satisfaction with the overall experience.

The Participant understands that personal enjoyment of the Trip may be influenced by factors outside the control of Wanderlush, including individual preferences, group interactions, travel pace, weather conditions, cultural differences, and other subjective elements of travel.

Personal dissatisfaction with the group dynamic, itinerary pace, accommodations, activities, or other subjective aspects of the experience does not constitute grounds for refunds, credits, or compensation. The Participant is expected to maintain a respectful, cooperative, and considerate attitude toward fellow travelers and hosts throughout the Trip.

 

PHOTOGRAPHY & MEDIA

During Trips organized by Wanderlush, photographs, video recordings, and other media may be captured by Wanderlush, its designated trip hosts, representatives, or other Participants.

 

By participating in a Trip, the Participant grants Wanderlush permission to use photographs, video, or other media in which they may appear for promotional, marketing, or informational purposes, including but not limited to use on websites, social media platforms, digital content, and other marketing materials without limitation as to location, format, or medium. Unless otherwise stated in writing, all photographs, video recordings, and other media captured by Wanderlush or its hosts or representatives during the Trip become the exclusive property of Wanderlush. The Participant acknowledges that such media may be used, edited, altered, copied, published, or distributed without compensation or additional approval and that Wanderlush is not obligated to provide copies of any media captured during the Trip.

 

If the Participant prefers to not appear in photographs or video content they are encouraged to notify Wanderlush in writing prior to departure, and reasonable efforts will be made to respect those preferences whenever possible.

Participants who share photographs, videos, or other media from a Trip on social media and tag or otherwise identify Wanderlush, grant the company permission to repost, share, or feature that content on Wanderlush’s social media platforms, website, or other marketing materials. When possible, Wanderlush will make reasonable efforts to credit the original creator of the content.

 

FORCE MAJEURE

Wanderlush shall not be liable for any failure, delay, or disruption in the performance of its obligations when such failure, delay, or disruption results from events or circumstances beyond its reasonable control.

Such events may include, but are not limited to:

• natural disasters or severe weather events

• pandemics, epidemics, or public health emergencies

• acts of war, armed conflict, terrorism, or civil unrest

• government actions, travel advisories, or border closures

• strikes, labor disputes, or transportation disruptions

• political instability or security conditions in the destination

• other unforeseeable events beyond the control of The Wanderlush Collective LLC

In the event of Force Majeure event materially affects the ability of a Trip to operate as planned, Wanderlush reserves the right to modify the itinerary, postpone the Trip, or cancel the Trip entirely. Wanderlush will make reasonable efforts to provide alternative arrangements, rescheduling options, or travel credits when feasible, but is not obligated to provide refunds for circumstances arising from Force Majeure events. 

In the event of a Force Majeure situation occurs but the Trip can proceed in whole or in part, Wanderlush reserves the right to continue, modify, or adjust the itinerary as reasonably necessary to ensure the safety and feasibility of the Trip. The Participant acknowledges that such circumstances may impact the planned itinerary, accommodations, activities, or overall experience, and agrees that participation under these conditions is voluntary. If the Participant chooses not to continue participation in the Trip under such circumstances, such decision shall be considered a voluntary cancellation by the Participant, and no refunds, credits, or compensation will be provided except as otherwise outlined in these Terms.

 

Wanderlush shall not be responsible for any additional expenses incurred by the Participant as a result of a Force Majeure event, including but not limited to airfare changes, additional accommodations, transportation costs, or other travel-related expenses.

 

LIMITATION OF LIABILITY

Wanderlush shall not be liable for any injury, loss, damage, delay, inconvenience, or expense arising from participation in a Trip, except where such liability is required by applicable law.

This includes, but is not limited to, losses or damages resulting from:

• acts or omissions of third-party suppliers including but not limited to airlines, hotels, accommodations, transportation providers, tour guides, activity operators, or other service providers

• travel delays or transportation disruptions

• weather conditions or natural events

• political instability, civil unrest, or security conditions

• accidents, illness, or medical emergencies

• loss, theft, or damage to personal belongings

The Participant acknowledges that travel involves inherent risks, and by booking and participating in a Trip, the Participant agrees that Wanderlush shall not be responsible for indirect, incidental, consequential, or special damages arising from participation in the Trip. In no event shall the total liability of Wanderlush exceed the amount paid by the Participant for the trip.

This limitation of liability applies to the fullest extent permitted by applicable law.

INDEMNIFICATION

By participating in a Wanderlush trip or using this website, you agree to indemnify, defend, and hold harmless Wanderlush, its owners, affiliates, partners, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• your participation in any Trip or experience  

• your violation of these Terms & Conditions  

• your violation of any applicable laws or regulations  

• your actions or conduct during a Wanderlush experience  

• any damage to property or harm to others caused by you  

Wanderlush reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification, in which case you agree to cooperate fully with such defense.

CHARGEBACKS & PAYMENT DISPUTES

The Participant agrees that any questions, concerns, or disputes regarding payments or charges should first be submitted directly to Wanderlush in writing, allowing Wanderlush a reasonable opportunity to review and resolve the matter before escalating to a third party.

Wanderlush recognizes that the Participant retains the right to dispute a charge with their bank or credit card provider in accordance with applicable law. However, by booking a Trip, the Participant acknowledges that all payments were made voluntarily, that the Participant reviewed the applicable Trip details and cancellation policy prior to booking, and that services provided or partially provided in accordance with these Terms are not grounds for a chargeback.​

In the event that a chargeback or payment dispute is initiated that Wanderlush determines to be inconsistent with these Terms & Conditions, Wanderlush reserves the right to submit booking records, these Terms, and any relevant documentation to the payment processor or financial institution in connection with its response to the dispute. Wanderlush further reserves the right to decline future bookings from the Participant who initiates a chargeback that is found to be without valid basis.

 

TIME LIMITATIONS 

To the fullest extent permitted by applicable law, any claim or cause of action arising out of or relating to these Terms & Conditions or participation in a Wanderlush Trip must be commenced within one (1) year from the date of the travel incident or event giving rise to the claim. This limitation period applies to the maximum extent permitted by New York law. Nothing in this provision is intended to shorten any limitation period that cannot be contractually reduced under applicable law.

 

WEBSITE USE

By accessing and using this website, you agree to use it for lawful purposes only. You may not use this site in any way that could damage, disable, overburden, or impair the website or interfere with any other party’s use of the site.

 

All content on this website, including but not limited to text, images, branding, logos, and design, is owned by Wanderlush or used under appropriate license and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or use any content from this site without prior written consent from Wanderlush or the applicable rights holder. Wanderlush makes reasonable efforts to ensure that information on this website is accurate and up to date; however, all content is provided for general informational purposes only and is subject to change at any time without notice.

Wanderlush shall not be liable for any damages arising from the use of, or inability to use, this website.

SEVERABILITY

 

If any provision of these Terms & Conditions is determined to be invalid, illegal, or unenforceable under applicable law, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

ACCEPTANCE OF TERMS

 

By booking a Wanderlush Trip, the Participant acknowledges that they have read, understood, and agree to be legally bound by these Terms & Conditions, including any policies referenced herein.

Use of the Website, completion of a booking, submission of a deposit or payment, or participation in any Wanderlush Trip constitutes acceptance of these Terms & Conditions.

Wanderlush reserves the right to update or modify these Terms & Conditions at any time. Unless otherwise required by applicable law, the version in effect at the time of the Participant’s booking will govern that booking. The Participant acknowledges that these Terms & Conditions apply to all individuals included in a reservation, and the person completing the booking represents and warrants that they have the authority to accept these Terms on behalf of any additional Participants associated with the booking.

These Terms & Conditions constitute the entire agreement between the Participant and The Wanderlush Collective LLC with respect to participation in a Trip.
